Terms & Conditions

Introduction

1.1 These Standard Contractual Terms and Conditions of Sale and Supply (“Agreement”) apply to all sales and supplies made by The Essential Vitamin Ltd. (“Seller”), a company registered in Ireland, trading worldwide, through its website essentivit.com (“Website”). The Buyer accepts these terms and conditions by placing an order for products through the Website.

Definitions

2.1 “Buyer” means the person or entity that purchases the products through the Website.
2.2 “Products” means the products and goods that the Seller offers for sale through the Website.
2.3 “Website” means essentivit.com.
2.4 “Seller” means The Essential Vitamin Ltd., a company registered in Ireland.

Orders

3.1 All orders are subject to acceptance by the Seller, and the Seller reserves the right to refuse or cancel any order at any time.
3.2 The Buyer is responsible for ensuring the accuracy of the order and providing all necessary information to the Seller to enable the Seller to fulfill the order.
3.3 Once the order is accepted, the Seller will send an email to the Buyer confirming the order and containing details of the order.

Prices and Payment

4.1 Prices for the Products are set out on the Website and are subject to change without notice.
4.2 The Buyer must pay the full price of the Products at the time of placing the order.
4.3 Payment for the Products must be made by credit card or any other payment method accepted by the Website.

Delivery and Risk

5.1 The Seller will make reasonable efforts to deliver the Products to the Buyer within the timeframe specified on the Website or as agreed with the Buyer.
5.2 The Buyer will be responsible for any customs duties, taxes, or other charges applicable to the delivery of the Products.
5.3 Risk in the Products passes to the Buyer upon delivery.

Warranty and Returns

6.1 The Seller warrants that the Products will be of satisfactory quality and fit for their intended purpose.
6.2 The Buyer may return the Products within 30 days of delivery for a refund, provided that the Products are returned in their original condition and packaging.
6.3 The Buyer must contact the Seller before returning the Products to obtain return authorisation.

Limitation of Liability

7.1 The Seller shall not be liable for any indirect, special, or consequential damages arising out of the sale or supply of the Products.
7.2 The Seller’s liability for any claim arising out of the sale or supply of the Products shall be limited to the purchase price of the Products.

Governing Law and Jurisdiction

8.1 This Agreement shall be governed by and construed in accordance with the laws of Ireland.
8.2 Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Ireland.

Entire Agreement

9.1 This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral, relating to the sale and supply of the Products.
9.2 No amendment or modification to this Agreement shall be effective unless it is in writing and signed by both parties.

By placing an order for Products through the Website, the Buyer agrees to be bound by these Standard Contractual Terms and Conditions of Sale and Supply.
